Introduction for Consultants and Clients to the NEC Engineering and Construction Contracts

Most publicly funded construction projects in Northern Ireland require the building contractor to be appointed under the NEC3 Construction Contract or its short equivalent.
As client, or as an architect acting on behalf of a client, it is therefore highly beneficial to understand the contractual commitments between the client and contractor under the NEC3 Construction Contract. Contractors are well versed in this regard and it is essential for the smooth operation of the project that the client and architect are equally well versed. This workshop provides a valuable introduction to these construction contracts.
NEC4 is now out and will also be covered in this workshop. Whilst public sector clients in Northern Ireland will be moving to NEC4 this is not expected to happen for approximately 12 months.
Objectives
At the end of the day, participants should appreciate:
- why the NEC was written
- its principal objectives
- how it is designed as a management tool
- the important clauses.
- key implementation points and
- advantages and disadvantages of using it
Programme
- Session 1 : Overview in 30 minutes.
- Session 2 : Participant wants
- Session 3 : Flexibility & Contract Strategy: when to use the standard (ECC) form vs the short form (ECSC); & which main ECC options of ECC; Exercise.
- Session 4 : A NEC3 project, key players and communications overview,
- Session 5 : Sections 1, 2, 4 & 5 : clauses if nothing changes, inc 1 exercise.
- Session 6 : Change Management : Accepted Programme, early warnings & Risk Reduction meetings, compensation events: definitions, timescales, assessment inc 1excercise
- Session 7 : Title, Risks & Insurance, Disputes & Termination
- Session 8: Key Implementation Points & Benefits
Who should attend?
This course is aimed at consultants and clients using the NEC Construction Contract. Previous knowledge of the contract is not required however the course is designed to be of particular benefit to current users of the contract.
Tutor
Dr Jon Broome is one of theUK’s leading consultants and trainers on the NEC. He completed a PhD on its effective operation. His contributions to the 2nd and 3rd editions are acknowledged in the contract. He has had numerous articles and papers, as well as the top selling ‘User’s Guide’ book published on the contract. John’s previous NEC3 training events with the RSUA have been rated as excellent by attendees.
