Contracting Concerns

During this one hour seminar, Lisa Boyd, Nuala Maguire and Emily Paisley from Eversheds Sutherland NI, will aim to give you a better understanding of the steps required to effectively terminate a construction contract as well as what redress you may have in the event the contractor or client experiences financial difficulties or becomes insolvent.

This session is therefore a must for anyone in Northern Ireland involved in the administration of construction contracts for clients as they will be involved in both an advisory and operational capacity with regards the termination of the contractor.  Equally, the termination of a contractor can impact the ongoing role of the architect within the project.

Discussions will also extend to the financial distress of the contractor.  Again, for architects in advisory roles, this will provide a broader understanding of the steps that can be taken to mitigate the risks and effects of contractor insolvency.

Attendees will also gain a better understanding of how to negotiate collateral warranties either on their own behalf or as a professional adviser to their client and discover the legal implications of insurance clauses within building contracts, professional appointments and collateral warranties. 

Speaker Bios

Lisa Boyd, with over 18 years experience, joined Eversheds Sutherland as Partner in Public Procurement and Construction in November 2023. Lisa has experience in both contentious and non-contentious public procurement and construction across a number of jurisdictions. Lisa’s experience includes JCT, NEC, RIBA as well as bespoke construction documentation. Lisa is ranked in Chambers as a Leading Individual for construction and is the only female in the jurisdiction to be ranked. Lisa is also a member of Executive Committee of the Procurement Lawyers’ Association and has presented to the cabinet office as part of the consultation on new Procurement Act in the UK.  Lisa has recently been invited by RSUA to draft the NI adaptation schedule for JCT D&B 2024.

Nuala Maguire joined Eversheds Sutherland as Of Counsel in Construction and Projects in January 2023. Nuala advises both public and private sector clients and has worked on multiple high profile construction cases in her 18 years in the legal industry. Nuala has experience advising on the various forms of construction and engineering contracts such as JCT, FIDIC, NEC, RIAI and related contracts such as collateral warranties and consultants’ appointments.

Emily Paisley is a Senior Associate for Eversheds Sutherland, joining the Dispute Resolution and Litigation team in April 2021. Emily specialises in commercial litigation, including contract disputes, insolvency, and construction litigation. Emily has acted for a number of main and sub-contractors in a variety of contractual disputes, adjudications and defence/enforcement of adjudication awards.
